These terms and conditions have been developed to create a safe and enjoyable environment and experience for you and your little fish!

It is best to take the time to read these terms and conditions carefully. You acknowledge and agree to these terms and conditions when visiting our swim schools and using our services.

1. Introduction 👋

Below are the Terms on which we offer the use of our Centre to you.

You must be over 18 years old to enter into this agreement. As the customer, guest, member or student, you may nominate a person under the age of 18 years of whom you are the parent, carer or guardian. You agree that you are bound by these terms and conditions personally and on their behalf.

If you require advice, guidance or clarification on these Terms, please chat with our Flips Assist team.

Unfortunately, if you do not accept these Terms, we must ask that you immediately leave and cease use of our Centre and services.

These Terms are subject to change. If any amendments or updates are made to these Terms, we will let you know via email to your nominated email address or a push notification from the Fish N Flips app.

2. Conditions of entry 🏡

We have a strict zero-tolerance (no fin-heads) policy for rude or disrespectful behaviour. For the benefit of all little fish and those attending our centre, we may refuse you entry to our centre or ask you to leave if you:

  • are abusive or use threatening language,
  • behave in a threatening way,
  • are under the influence of drugs or alcohol (or we reasonably believe you are under the influence of drugs or alcohol),
  • are smoking or vaping,
  • behave in a way that we consider to be inappropriate,
  • or breach any of these Terms.

3. Swimming class bookings

You can enrol your little fish into a class via our customer app, or with one of our Flip’s Assist team in person, over the phone or by email. This booking will continue and guarantee your place in the class until you notify us that you wish to change lesson times or cancel your booking.

Swimming lessons will not run on national public holidays unless otherwise advertised. If there are any other disruptions to classes running, we will do our best to get in contact to let you know.

4. Changing your booking

If you are finding your lesson time doesn’t fit you and your little fish’s schedule, you can get in touch with our Flip’s Assist team by phone or email. 

Once we find a new time that suits you, we will adjust your booking and send you a confirmation it has been changed 😀 

You can even change your booking time on our app as well! Log in, view your child’s current booking and request a transfer to a different time or day.

5. Cancelling your swimming classes

If you wish to cancel your little fish’s swimming lessons, you must provide notice in writing by emailing your site directly. The team can action this cancellation with just one additional lesson charged for your notice period. If you are a super organised fish and want to cancel for a few weeks in advance, your direct debit will continue as usual and finish on the final week 😊

6. Make-up classes

We understand that sometimes life can get in the way, and you may need to miss a lesson or a few. That is why we allow unlimited make ups for the whole family.

To receive a make up, poppp onto our app, and cancel your attendance before the class starts. A token will be made available on your account after the classes scheduled time. Tokens can only be booked up to 7 days in advance and will expire after 30 days.

Your little fish needs to be currently enrolled to be able to redeem your makeup tokens. These tokens can’t be shared between little fish and will expire if their booking is cancelled.

*This make up policy does not apply to Private Classes.

7. Lifestyle hold 🏖️

Life gets complex sometimes. That is why we offer tailored class hold options for when you need to miss more than a week or two of classes. Please speak with your Chief Flipper on site or via email to explore our 2-4 week lifestyle hold options for your classes. Lifestyle holds are only available once a year per child.

8. Fees and payments 💳

To make things as simple and flexible for you and your bank account. Fees for your classes are calculated seven days before the class and are direct debited weekly on Thursdays from your nominated bank account or credit card.

Occasionally a direct debit might fail, and we may process this on the next banking day or leave the outstanding balance on your account (which will need to be paid before your next lesson). In the event that your account falls more than 7 days in arrears we may suspend your service until the outstanding balance is settled.

A $5 rejection fee may apply if your direct debit is unsuccessful.

If your little fish’s class falls on a public holiday that we are closed for or during our annual holiday break over the New Year period, you won’t be charged your normal fees.

To allow us to continue providing affordable swimming lessons for all families and to create an environment for little fish to play, laugh, and learn lifelong skills. From time to time, we may increase our fees. These increases are only made after careful consideration. Any increase will be communicated to you at least 4 weeks in advance.

9.Private Lessons 

At Fish n Flips, we provide private classes on a case-by-case basis for little fish who need a bit more support. They run during non-peak periods to ensure the best environment for a little fish who may require specialised staff & additional planning.

Private classes are paid weekly in advance. If you can’t attend your lesson, we require notice by 5 pm for classes running the following morning & 8 am for classes running that afternoon. As part of your private classes, you receive 6 credits annually for missed lessons. This notice ensures one of these credits will be available to you to use. If you do not give notice by the mentioned times, you will forfeit your lesson fees. Private Lesson Credits are the lesson amount applied to the swimmers’ family account to be used against future lessons.

10. Supervision 😎

When you and your little fish are at one of our swim schools, you need to keep your eyes on your little fish at all times. While our Flips crew and team take precautions to keep everyone safe, you are responsible for your little fish. If your little fish is under five, stay within arm’s reach of them at all times.

Stay distraction-free (Including phones 😉) and enjoy watching your little fish play, laugh and learn. Often your little fish will look for your acknowledgement when they achieve something special, this is a moment you don’t want to miss!

11. Cleanliness and Hygiene 🧼

So all the little fish and our crew stay healthy, we have a couple of requests to maintain our swim school and water qualities hygiene:

  • Little fish with long hair wear a swimming cap while in the water.
  • If you or your little fish are sick, we ask that you don’t attend lessons.
  • All little fish younger than 3 should wear a swim nappy during their lesson. 

We request that you follow all current guidelines outlined by the health department.

12. Damage to centre 💔

If you accidentally or purposely damage our swim school or equipment. You agree that we may ask that you compensate us for any damages.

While attending our swim school, we may take photos or videos of you and your little fish. We will let you know that we are taking images. If you prefer not to be in them, we will try to avoid capturing you and your little fish.

These photos and videos may be used in our training and marketing. By participating in our service and visiting our swims school, you consent to have your and your little fish’s imagery captured, and that Fish N Flips owns all rights to this imagery.

If you want to take photos or videos of your little fish, we ask when you take these. You do your best to not include any other people in the imagery.

14. Entire agreement

These terms and conditions cover the understanding between yourself and us for your little fish’s swimming classes and your use of our swim school.

15. Waiver of liability 📘

By coming to our swim school, you understand that when you are inside of our venues, there are risks you and your little fish are exposed to. Including but not limited to theft, property damage, tripping, falling, sickness, infection, drowning, death and/or other damages. These risks and damages may come from foreseeable or unforeseeable causes. 

When you come to our swim school, you voluntarily recognise, accept and assume all risk and responsibility except for when the injury or damages is caused by gross negligence by Fish N Flips.

By visiting our Swim School and participating in our services you release, waive, discharge, hold harmless and indemnify Fish N Flips from all claims, losses, injuries, liabilities, damages, and causes of action of any nature against Fish N Flips.

16. Severability

If any part of our terms and conditions becomes invalid, unenforceable or unlawful. All unaffected terms will remain relevant and continue to be used and implemented.

17. Governing Law

Our terms and conditions are applied and translated by the legislation of the state or territory where your Fish N Flips swim school is located.

As part of our terms and conditions, you agree to receive communications from us regarding your lessons, event and other information.
