These terms and conditions have been developed to create a safe and enjoyable environment and experience for you and your little fish!

It is best to take the time to read these terms and conditions carefully. You acknowledge and agree to these terms and conditions when visiting our swim schools and using our services.

1. Introduction 👋

Below are our terms of service that apply to all enrolled parties at Fish n Flips Swim School.

2. Conditions of entry 🏡

At Fish n Flips, we have a strict zero-tolerance policy for rude or disrespectful behaviour; we are a child-centric business after all.

If this occurs, we may refuse entry or terminate your service by providing written notice.

3. Enrolments

Our lessons run all year round except for major holidays (Easter/Christmas) and elected public holidays; you will not be charged unless otherwise advised during these holiday periods.

At the time of enrolment, you will be enrolled as an active perpetual booking (same time & day each week on a continued basis) until you advise changing your enrolment day or time. This can be done through the app or by directly calling/emailing the centre.

You must complete our online Cancellation request form to cancel your enrollment permanently. A cancellation notice period of 7 days applies to all enrolments.

4. Charges & Payments

Lessons are charged weekly via Direct Debit 7 days in advance on a Thursday morning (the charge would include lessons from that Thursday to the following Wednesday). To set up your direct debit details, jump into our app & populate either a credit card or bank account. Payments are due regardless of your little fishes’ attendance at their enrolled class, and refunds will not be issued for non-attendance. Make-ups serve the purpose of catch-up classes. 

If a direct debit fails, the venue may retry charging your payment method on file the following day. Should this be unsuccessful, you will need to pay any outstanding amounts before your next class. Accounts overdue by more than 7 days may be subject to enrolment suspension or cancellation until the amount is settled. 

Failed payments may incur a $5 rejection fee, which our debiting provider charges. Your next successful debited payment will include any rejection fees accrued. 

Fees may be subject to change annually; we will provide at least 4 weeks’ in writing of any changes to our fee schedules.

5. Make-ups

Life can get in the way sometimes, which might cause you to miss a few lessons. That is why we allow unlimited make-up tokens for the whole family. To be entitled to a make-up token, you must advise absence at least 1 hour before the class via our app or email/call the centre. You can access these tokens to book a catch-up class up to 7 days in advance. Make sure to get in quickly, as tokens will expire on your account after 30 days. You can only redeem make-up tokens if you are an actively enrolled customer & these can’t be shared between little Fish. 

This make-up policy does not apply to private lessons.

6. Lifestyle Hold 🏖️

At Fish n Flips, we offer customers the option of a 2-4 week lifestyle hold once per calendar year, per child. Lifestyle allows you to keep your enrollment time/day without being charged for the period. We require a minimum of 7 days notice for your lifestyle hold to take effect.

These can be used for holidays, sicknesses or if you need a quick break. To submit a lifestyle hold request, please complete the online form here.

7. Private Lessons

Sometimes, Little Fish need some extra support and may need private lessons. These run during non-peak periods to ensure the best environment for Little Fish, requiring specialised staff or additional planning. Due to the nature of private classes, our standard make-up policy does not apply.

Instead, we need notice by 5 pm for classes running the following morning & 8 am for classes running that afternoon. You can receive up to 6 private credits annually for missed lessons as part of your private classes. Private credits are the lesson amount applied to the family account to be used against future charged lessons. You must provide notice, as mentioned above, to redeem a private credit.

8. Supervision 😎

When you and your Little Fish are at one of our swim schools, you must always keep your eyes on your Little Fish. While our Flips crew and team take precautions to keep everyone safe, you are responsible for your Little Fish. If your Little Fish is under five, stay within arm’s reach of them at all times.

Stay distraction-free (Including phones 😉) and enjoy watching your little Fish play, laugh and learn. Your Little Fish will often look for your acknowledgement when they achieve something special. This moment is one you don’t want to miss!

9. Cleanliness & Hygiene

So all the little Fish and our crew stay healthy, we have a couple of requests to maintain our swim school and water quality hygiene:

  • Little Fish with long hair wear a swimming cap while in the water.
  • If you or your Little Fish are sick, we ask you not to attend lessons.
  • All Little Fish younger than 3 years old should wear a swim nappy during their lessons. 

We request that you follow all current guidelines outlined by the health department.

10. Consent to photography

While attending our swim school, we may take photos or videos of you and your Little Fish. We will let you know that we are taking images. If you prefer not to be in them, you must advise us of this in writing, we will try to avoid capturing you and your Little Fish. We will update your file with this preference and to the best of our ability meet this request.

We may use these photos and videos in our training and marketing. By participating in our service and visiting our swim school, you consent to have your and your little Fish’s imagery captured and that Fish N Flips owns all rights to this imagery.

If you want to take photos or videos of your little Fish, we ask that when you take these, you do your best not to include other people in the imagery.

11. Communication

As part of our terms and conditions, you agree to receive communications regarding your lessons, events and other information.

12. Waiver, Severability & Governing Law

By coming to our swim school, you understand that when you are inside our venues, you and your little Fish are exposed to risks. Including but not limited to theft, property damage, tripping, falling, sickness, infection, drowning, death or other damages. These risks and damages may come from foreseeable or unforeseeable causes. 

When you come to our swim school, you voluntarily recognise, accept and assume all risk and responsibility except for when the injury or damages are caused by gross negligence by Fish N Flips.

By visiting our Swim School and participating in our services, you release, waive, discharge, hold harmless and indemnify Fish N Flips from all claims, losses, injuries, liabilities, damages, and causes of action of any nature against Fish N Flips.

If any part of our terms and conditions becomes invalid, unenforceable or unlawful. All unaffected terms will remain relevant and continue to be used and implemented.

Our terms and conditions are applied and translated by the state or territory legislation where your Fish N Flips swim school is located.
